1. About These Terms

These Terms of Service govern your use of the 5 Minute Roof Quote website and services. 5 Minute Roof Quote is operated by 5MQ Pty Ltd (ACN 701 857 614) (“we”, “us” or “our”). By using our website or submitting a property-related enquiry, you agree to these Terms.

2. Definitions

In these Terms:

• Platform means the 5 Minute Roof Quote website and associated services.
• Property User means any person who uses the Platform in connection with a residential or commercial property, including an owner, homeowner, landlord, tenant, renter, property manager, strata manager, agent, prospective purchaser or other person seeking information, estimates, quotations or roofing services in relation to a property.
• Contractor means an independent roofing contractor or roofing business participating in or using the Platform.

3. Our Service

5 Minute Roof Quote provides an online service designed to help Property Users obtain an indicative estimate for roofing work and connect with roofing contractors. We are not a roofing contractor. We do not carry out roofing work, provide roofing services or enter into contracts for roofing work on behalf of Contractors. Our role is limited to providing information and facilitating introductions between Property Users and independent Contractors.

4. Indicative Estimates

Any estimate, pricing range or other information provided through our Platform is indicative only. Estimates may be based on information provided by you, publicly available information, imagery, property data, assumptions and other information available to us. An estimate is not:

• a formal quotation;
• a guarantee of the cost of roofing work;
• a representation that work can be completed for a particular price;
• confirmation of the condition of a property or roof;
• a substitute for an inspection or formal quotation by a suitably qualified Contractor.

Actual costs may differ materially due to site conditions, roof design, access, materials, labour costs, structural issues, regulatory requirements, the nature of the property and other factors. You should obtain and consider formal quotations before making decisions about roofing work.

5. Contractor Matching

We may identify Contractors that operate in or near your area and may be relevant to your enquiry. You may choose whether to request contact from a Contractor presented to you through the Platform. We do not guarantee:

• that Contractors will be available in your area;
• that you will receive a particular number of responses or quotations;
• that a Contractor will contact you;
• that a Contractor will provide a quotation;
• any response time;
• the price quoted by a Contractor;
• the quality, safety or outcome of any work;
• that a Contractor will accept or complete your project.

6. Independent Contractors

Contractors using our Platform are independent businesses. We do not control or supervise Contractors or the work they perform. We are not responsible for:

• Contractor conduct;
• Contractor availability;
• Contractor pricing;
• Contractor workmanship;
• delays;
• property damage;
• injuries;
• contractual disputes;
• any agreement entered into between you and a Contractor.

You are responsible for determining whether you wish to engage a Contractor and for conducting any due diligence you consider appropriate.

7. Authority in Relation to a Property

You represent that you have authority to submit information and make enquiries in relation to the relevant property. Where you are not the legal owner of a property, you are responsible for obtaining any permission, approval or authority required before arranging inspections, authorising access, approving work, entering into an agreement or otherwise proceeding with roofing work. 5 Minute Roof Quote does not verify whether you own a property or have authority to arrange, approve or authorise roofing work in relation to that property.

8. Your Information and Consent

By submitting an enquiry and selecting or requesting contact from a Contractor through the Platform, you authorise us to provide relevant information about your enquiry to that Contractor. You consent to Contractors you select contacting you regarding your enquiry by telephone, SMS or email. You also consent to us contacting you regarding your enquiry and the operation of our service. Our handling of personal information is governed by our Privacy Policy.

9. Accuracy of Information

You must provide information that is accurate and not misleading to the best of your knowledge. We may suspend, cancel or decline to process an enquiry where we reasonably believe that information provided is false, misleading, incomplete or inappropriate.

10. Free Service

Our service is currently provided without charge to Property Users. We may receive fees from Contractors in connection with introductions or Leads generated through the Platform. Contractor payments do not guarantee that a particular Contractor will be selected or recommended to you.

11. No Professional Advice

Information provided through our Platform is general information only. Nothing on our website constitutes engineering, construction, roofing, building, legal, financial or other professional advice. You should obtain independent professional advice where appropriate.

12. Limitation of Liability

To the maximum extent permitted by law, we exclude liability for any loss, damage, cost or expense arising from:

• your use of our website or services;
• reliance on an indicative estimate;
• information provided through the Platform;
• contact or dealings with a Contractor;
• any work performed by a Contractor.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified. Where liability cannot lawfully be excluded, our liability is limited to the maximum extent permitted by applicable law.

13. Intellectual Property

The content, software, branding, design, text, graphics and other materials available through our website are owned by or licensed to us and may not be copied, reproduced or used without our permission except as permitted by law.

14. Changes to Our Service or Terms

We may modify, suspend or discontinue any part of our website or services from time to time. We may also update these Terms. Updated Terms will apply from the date they are published on our website.

15. Governing Law

These Terms are governed by the laws of South Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia and courts entitled to hear appeals from them.
